Congressional Commerce Subcommittee Democrats Seek to Advance FTC Act 13(b) Reform Legislation
On May 27, 2021, the House Energy and Commerce Committee’s Subcommittee on Consumer Protection and Commerce sought to advance H.R. 2668, a bill intended to clarify the Federal Trade Commission’s authority under Section 13(b) of the Federal Trade Act. Just weeks earlier, the U.S. Supreme Court dealt a serious blow to the FTC’s authority to seek and obtain monetary relief in federal court pursuant to Section 13(b) in the matter of AMG Capital Management, LLC
v. FTC.
Dubbed the Consumer Protection and Recovery Act, the proposed legislation explicitly authorize the FTC lawyers to seek permanent injunctions and other equitable relief, such as restitution and disgorgement, to remedy consumer injury.
